Terms of use.

Short, because there is not much to agree to: nothing here costs money, there is no account to close and no subscription to cancel. What matters is what a score from this software does and does not mean, and that is the second section.

Vitals · vitals 0.10.4 · operated by MegaWiz Co., Ltd., Bangkok · paripol@megawiz.co

1 · Who runs this

Vitals is built and operated by MegaWiz Co., Ltd.

MegaWiz Co., Ltd., Bangkok, Thailand — the product company behind the Embla clinical-simulation engine, whose physiology automaton and encounter engine Vitals reuses. Contact for anything on this page: paripol@megawiz.co.

Using this site means these terms apply to your use of it. If you do not accept them, do not use it — and nothing is lost, because there is no account to delete.

2 · The one that matters

This is training software. A score here is not a clinical qualification, and nothing in it is advice about the care of a real patient.

Vitals is a simulator. Every patient in it is synthetic. It exists so that a learner can make a decision under time pressure and find out what the physiology does about it, which is a rehearsal and not a clinical act.

Nothing in these terms limits any liability that cannot lawfully be limited, and no wording here is meant to stand between anyone and their duty of care to a real patient.

3 · What free means

No learner is ever charged, in any country. That is a commitment, not a trial.

There is no paywall, no seat, no subscription and no upsell, and there is no plan for one. Donations pay for the compute behind free play, and they buy a monthly ceiling on paid inference rather than anybody's access. When the month's ceiling is reached the bay keeps running and only the patient's voice stops until the month turns. What the ceiling is, how much of it is spent and what is in the treasury are all published live on the donate page.

What free does not promise

4 · Licence

The code is AGPL-3.0-or-later, plus a commercial licence.

Vitals is open source under the GNU Affero General Public License, version 3 or later, with a separate commercial licence available from MegaWiz. The LICENSE file in the repository is the authority on what you may do with the code; this page does not modify, extend or reinterpret it, and where they differ the licence wins.

One clause is worth naming because people miss it: the AGPL's section 13 means that if you run a modified copy of this software as a network service, you must offer its users the source of your modified version. That is the licence we chose on purpose.

The licence covers the code. It does not automatically cover everything served alongside it — clinical images carry their own terms and their own required attribution, which travels with them in the repository, and some are CC-BY 4.0, where credit is a condition rather than a courtesy. The Embla case corpora and knowledge base are not in this repository and are not licensed by it.

5 · Anchoring

The one action on this site that cannot be undone.

Pressing anchor this run on chain writes a permanent, public record under your browser's key. We cannot delete, edit or correct it afterwards, and neither can you. It is opt-in, it is never automatic, and you can use everything else here without ever pressing it.

Read the privacy page, section 1 before you press it. It lists exactly what a stranger can see in an anchored record, exactly what they cannot, and what changes the moment you tell anyone that key is yours. That is a decision to make before, not after.

6 · Fair use of a free bay

What not to do here.

We may rate-limit, block or refuse service to traffic that is doing any of the above. There is no account to suspend, so in practice this means an address, and it is a technical measure rather than a penalty.

7 · Warranty

There is none.

The software and this service are provided "as is", without warranty of any kind, express or implied — including any warranty of merchantability, fitness for a particular purpose, or that the simulation is clinically correct. That is the licence's own position and it is ours: read sections 15 to 17 of the AGPL in LICENSE, which govern the code.

The simulation is a model of a body, and a model is wrong in ways its authors have not found yet. Where clinical content here has been reviewed by a physician we say so beside it and name what was ruled on; where it has not, it has not. Treat an unreviewed case as a rehearsal, never as a reference.

Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

8 · What this page does not settle

No lawyer has read this.

These terms were written by the people who wrote the software, to describe honestly what it does and what it is not. They name no governing law and no forum, and they do not attempt to state your statutory rights or ours. Those are questions for a professional, and inventing an answer to them would be exactly the failure this project has spent its time removing everywhere else. When a lawyer has reviewed this page, it will say so and say who.

This page is compiled into the server binary, so it changes only when a new build is deployed; the build it belongs to is stamped at the top. If a change matters, the repository's history records what changed and when.
